In a further action against the Lord Advocate in relation to financial dealings in Rangers FC alleging malicious prosecution, Lord Tyre has provided a legal opinion on the significance of irrelevant criminal charges.

Lord Tyre states that where criminal charges are dismissed as irrelevant, it will generally be difficult to argue that reasonable and probable cause to bring a prosecution existed, from an objective standpoint.
